WAIA Code of Conduct

This is the WAIA code of conduct for online service providers, version 1.03, as ratified by the WAIA committee on 30th April 1997.

Definitions

An "online service provider" includes an internet access provider, an internet service provider and a bulletin board system operator. The obligations and duties of an online service provider may vary depending on the nature of the service provided and upon the nature of the user access. 

"Cache" facilities mean the provision of a buffer in memory or on disk of frequently accessed web pages.

 

"Mailbox" facilities mean the provision of an email address and the capacity of the user to send and receive electronic mail.

"Directory" facilities mean a user's allocation of disk resources as part of an Internet access account.

  1. I , as an online service provider shall not:
    1. Knowingly permit those parts of my system under my control to have publicly available for downloading files which infringe copyright or contain unlawful material , provided that the provision of cache , mailbox or directory usage to users shall not
      constitute permission to misuse such facilities.
    2. Knowingly permit a user to engage in criminal activity using access to my system , provided that such activity is identified as criminal by competent law enforcement authorities.
  2. I , as an online service provider shall:
    1. Attempt to establish the name and age of all users with accounts on my system by reference to proof of name and address on application.
    2. Adhere to all lawful requirements concerning civil orders, criminal procedures , injunctions and rules of law relating to the operation of my system and the activities of users upon it.
    3. Attempt to safeguard the privacy of my users and their data in all respects subject to reasonable actions necessary to ensure proper operation of my system and compliance with this Code.
    4. Appropriately deal with any user compromising compliance with this Code , including but not limited to removal of that user's access.
    5. Deal responsibly with complaint from any source concerning a breach of this Code , including referring the matter where appropriate to WAIA.
    6. Comply with rulings of the WAIA complaints subcommittee.
    7. During currency of my membership of WAIA , inform users of my system's adherence to this Code in all contracts of service provision.
